eTaxCare Confidentiality Policy

The protection of Confidential Information and Trade Secrets is vital to the interests and success of Electronic Settlements, Inc., the eTaxCare division, and our clients. The aim of the following policy is to identify that information which is considered to be Confidential and to outline the appropriate use and collection of information.

Definition of Confidential Information

Confidential Information is a special, valuable and unique asset of the eTaxCare division and the eTaxCare division’s clients, and as such, it is considered to be proprietary to the eTaxCare division and/or the eTaxCare division’s clients, protected by civil and criminal laws, and its use and disclosure must be carefully and continuously controlled. Confidential Information includes, but is not limited to the following:

Furthermore, any Confidential Information shall remain at all times the exclusive property of the eTaxCare division or the eTaxCare division' clients, and our employees shall have no right, title, or interest whatsoever in any such information.

Employee use and disclosure of confidential information

Although the use and disclosure of Confidential Information must be strictly regulated, employees of the eTaxCare division must have access to this information in order to effectively perform their duties and responsibilities. To balance the interests, the employee's use of such Confidential Information then shall be limited to that which is necessary for the performance of program services relative to their employment position. Each employee shall use the same degree of care in safe-guarding this Confidential Information as they would if they owned proprietary information of like importance.

In addition, the eTaxCare division employees are strictly prohibited from divulging, furnishing, trading, bartering, lending, selling, or in any other way making any Confidential Information available to anyone unauthorized to receive or view such information.

In the event that an employee leaves, or plans to leave their employment at the eTaxCare division, all Confidential Information shall be immediately returned.

Violations

Employees who improperly use or disclose trade secrets or confidential business information will be subject to disciplinary action, up to and including termination of employment and possible legal action. Disciplinary action may be warranted even in those situations where the employee did not actually benefit from the disclosure of the Confidential Information.

Confidentiality Acknowledgement

All employees shall be informed of this policy on the first day of their Learning Center Orientation and they shall be required to sign a Confidentiality Acknowledgement as a condition of employment.
